By signing this liability waiver, I expressly agree that Boards & More GmbH (“B&M”), including all affiliated brands, distributors, authorized agents, instructors, event organizers, and partners (collectively the “B&M Group”), cannot be held liable or sued under any circumstances. This includes all claims arising from personal injury, property damage, or financial loss occurring during or in connection with the testing event.

I understand that water sports involve inherent risks and may lead to serious injury or death. I agree to follow all instructions given by the event organizers or instructors, respect all safety rules, and avoid causing damage to equipment, other participants, or third parties.

I am personally responsible for any damage I may cause to rented equipment or third-party property. I confirm that I either hold a valid license for the relevant activity or that I am sufficiently experienced to safely participate. I will use all required safety gear such as helmets, impact vests, or buoyancy aids.

I agree to participate in the B&M demo event and test B&M equipment free of charge. For this purpose, I consent to registering in B&M’s rental software and creating a user account.

For the execution of the event, B&M may store and process the following data: form of address, name, address, country, e-mail address, phone number, and the products rented by me. These data may be combined with existing B&M records to evaluate product performance and improve services. I expressly consent that B&M sales representatives may contact me solely for event-related feedback (e.g., regarding my test experience). This contact is strictly event-related and not a newsletter subscription.

I acknowledge that authorized B&M agents and distributors operate the event on behalf of B&M and that participant data may be stored in B&M’s internal systems for operational reasons.

The DUOTONE Foil Assist is a powered foiling system involving significant risks, including serious injury, property damage, or death. By participating in this test event, I acknowledge and accept all known and unknown risks associated with using this equipment.

The system includes sharp components, a high-torque motor with an exposed propeller, and lithium batteries. Incorrect handling, collisions, environmental hazards, or failure to follow safety instructions may result in accidents or severe injury.

B&M Group assumes no liability for injuries, damages, or losses related to the use of the Foil Assist system. By signing this waiver, I waive all claims against the B&M Group and agree to operate the equipment responsibly, wear all required safety gear, and follow local regulations.

Participation in the testing event does not automatically include newsletter registration. Newsletter subscription requires separate, explicit consent.

If I voluntarily subscribe to the newsletter, I consent to my data being transferred to and processed in Klaviyo in accordance with applicable data protection laws.

Event-related communication (feedback requests, safety notifications, operational info) remains permissible without newsletter consent.

This waiver does not require a handwritten signature. A digital confirmation (e.g., clicking a checkbox or digital button) is fully valid and legally binding.

This waiver applies to all products and brands of B&M made available during the specific test event.
